Terms & Conditions
Effective August 25, 2026. These terms govern your use of peteseatspinellas.com and the services of Pete's Eats Pinellas.
1. Agreement to these terms
By using this website, submitting a form on it, renting a spot at our venue, or communicating with us by phone, email, or text message, you agree to these Terms & Conditions. If you do not agree, please do not use the site or our services.
2. Who we are
Pete's Eats Pinellas operates an outdoor food truck park located at 5796 66th St N, St. Petersburg, FL 33709. You can reach us at (727) 545-4500. In these terms, "we," "us," and "our" refer to Pete's Eats Pinellas; "you" refers to the person using the site or our services.
3. The venue and our services
We host independent food trucks and provide outdoor seating for the public, and we rent monthly spots to food truck operators. The trucks that appear at the park are independent businesses. They set their own menus, prices, and hours, and they are responsible for their own food preparation, food safety, licensing, and service. We do not prepare or sell food ourselves, and we are not responsible for the products or conduct of individual vendors.
The park is Open daily 11am to 7pm. Individual trucks set their own schedules within those hours, so the lineup on any given day may vary.
4. Vendor applications and spot rentals
Submitting the vendor application form is a request, not a reservation. It does not create a rental agreement, does not guarantee availability, and does not lock in any rate. A spot is rented only when we confirm it with you directly and any separate rental agreement is signed.
Vendors are responsible for holding all licenses, permits, and insurance required by the State of Florida, Pinellas County, and the City of St. Petersburg for their operation. We may decline any application, and we may end a rental in accordance with the rental agreement.
5. Rent and payments
Rent amounts, due dates, and accepted payment methods are set out in your rental agreement with us. Where we offer online payment, it is processed on the secure hosted page of a third-party payment processor. We do not collect or store your card or bank details on this website. Your use of that processor is subject to its own terms and privacy policy.
6. Text (SMS) communications
This section describes our text messaging program. Our Privacy Policy explains how we handle your mobile number itself.
How you consent
We send text messages only to people who have given us their mobile number and agreed to be texted. Consent is given at these specific places:
- By submitting your mobile phone number and checking the text-message consent box on our Vendor application form at peteseatspinellas.com/rent-a-spot, you consent to receive transactional and customer-care SMS messages from Pete's Eats Pinellas related to your inquiry. That form is used by food truck operators applying for a monthly spot.
Providing your mobile number and consenting to texts is optional. It is not a condition of applying for a spot, renting a spot, or purchasing anything from us. If you would rather not receive texts, leave the consent box unchecked and we will contact you by phone or email instead.
What we send
Our program is transactional and customer-care. Messages relate to your own inquiry, application, or spot rental, and may include:
- Confirmation that an application was received
- Spot availability and rate information you asked for
- Scheduling and check-in details for your spot
- Rent and payment reminders
- Logistical updates about the park that affect your spot
- Replies to questions you send us
We do not send marketing or promotional SMS messages.
Frequency and cost
Message frequency varies. Message and data rates may apply. We do not charge you for the messages themselves; any charges come from your own mobile carrier under your plan.
How to stop messages, and how to get help
You may opt out at any time by replying STOP to any message. For assistance, reply HELP or contact us directly.
After you reply STOP, we will send one final message confirming that you have been unsubscribed, and we will not send you further texts unless you opt in again. Replying HELP returns our business name and contact details. You can also opt out or ask for help by calling (727) 545-4500.
Opting out of texts does not stop us from contacting you by phone or email about an application or rental you have with us.
Carriers and delivery
Supported carriers include the major US mobile carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed, so please do not rely on SMS for urgent or time-critical matters. Call us instead.
7. Phone calls and email
If you give us your phone number or email address, we may contact you at them about your inquiry, application, or rental. Calls may be returned during normal business hours.
8. Your responsibilities at the venue
The park is an outdoor space open to the public. Please use it responsibly, supervise children, clean up after yourself, and follow posted rules and any direction from staff. We may ask anyone behaving unsafely or disruptively to leave. You are responsible for your own property while on the premises.
9. Website content and intellectual property
The content on this site, including text, layout, graphics, and photographs, is owned by us or used with permission, and is protected by copyright and other laws. You may view and print pages for your own personal or business use. You may not republish, sell, or use our content commercially without our written permission.
Photographs on this site may be illustrative and may not depict the vendors currently at the park.
10. Third-party links and services
This site links to third-party services, including mapping services and a payment processor, and loads web fonts from a third-party provider. We do not control those services and are not responsible for their content, availability, or practices. Their own terms and privacy policies apply.
11. Disclaimers
This website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted or error-free, or that information on it, including vendor lineups, hours, and rates, is complete or current. Vendor lineups and hours change frequently; please call to confirm before you travel.
12. Limitation of liability
To the fullest extent permitted by Florida law, Pete's Eats Pinellas and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of your use of this website, your visit to the venue, or your dealings with any vendor. Nothing in these terms limits liability that cannot be limited by law.
13. Indemnification
You agree to indemnify and hold harmless Pete's Eats Pinellas from claims, damages, and reasonable expenses arising out of your misuse of this site, your violation of these terms, or your violation of the rights of another.
14. Governing law and venue
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Pinellas County, Florida, and you consent to their jurisdiction.
15. Changes to these terms
We may update these terms from time to time. The effective date at the top of this page shows when they were last revised. Material changes to our text messaging program will be reflected here and, where required, we will ask for your consent again. Continuing to use the site after an update means you accept the revised terms.
